Penalties in drug conspiracy cases

If convicted, a defendant in a federal drug conspiracy case may receive a mandatory minimum sentence of ten years and a maximum of life in prison for the following amounts of drugs:

  • 50 grams of meth or 500 grams of a mixture containing meth
  • 1 kilogram or more of a mixture or substance containing heroin
  • 5 kilograms of cocaine
  • 1000 kilograms of a mixture or substance containing marijuana or more than 1000 plants 
  • 400 grams of fentanyl

A defendant may receive a mandatory minimum sentence of 5 years and a maximum of 40 years in prison for the following amounts of drugs:

  • 5 grams of meth or 50 grams of a mixture containing meth
  • 100 grams or more of a mixture or substance containing heroin
  • 500 grams of cocaine
  • 100 kilograms of a mixture or substance containing marijuana or more than 100 plants 
  • 40 grams of fentanyl 

Common defenses in federal drug conspiracy charge cases

Common legal defenses include that the prosecutors did not prove beyond a reasonable doubt any of the five key elements of federal drug conspiracy charges. For example, these may include that the defendant did not know the goal nor knowingly involved themselves or that there lacked interdependence amongst the conspirators.
